Our expertise is grounded in extracting, processing, and translating complex data, which are skills that enable us to quickly and effectively engage in new subject matters. We build platforms and reports that integrate disparate data and make findings accessible to non-technical collaborators. Our approach is comprehensive and detailed, leveraging industry-standard, peer-reviewed approaches and tools – we don't make assumptions, we reveal the truth hidden in the data.

  • We support across the litigation and investigation lifecycle in various consulting capacities. We engage as early as possible, often before formal discovery, to help clients shape data strategy and maximize the value of produced information. This includes advising on discovery requests, identifying key data sources, and assessing the structure, limitations, and reliability of available data. By working closely with client teams throughout the case lifecycle, we help clarify what data exists, how it fits together, and how it can be used to inform case development, discovery priorities, and downstream analysis.

  • We extract, structure, and analyze large-scale structured (Excel, CSV, databases) and unstructured (PDFs, text messages, emails) datasets. Our team has served as both consulting and testifying experts in a range of matters. Consulting work has included advising on matters such as logical and effective ways to present evidence (e.g., Rule 1006 summaries) and strategies for corporate witness (30(b)6) depositions. We apply our data expertise across a range of industries and sectors, producing transparent, reproducible analyses that can be clearly explained and defended in reports, depositions, and testimony.

  • We take a data-driven approach to damages and settlement analysis, particularly in matters where harms are complex or difficult to quantify. Our work includes statistical forecasting of claim values, damages calculations, and allocation methodologies based on reviewed claims and defined criteria.

  • We work closely with government agencies, law enforcement, and litigation teams on investigative and early case development efforts. This often involves analyzing publicly available data to identify particular trends or potential indicators of misconduct or harm. Our investigative work helps assess whether claims are supported by data, informs case strategy, and guides data requests as matters progress.

Our work in healthcare spans a range of matters, including pharmaceutical distribution, medical device safety, overbilling, and network adequacy. Most notably, MK Analytics has played a central analytical role in the National Opioids Litigation, where our co-founder, Lacey Keller, serves as an expert witness. Across engagements, we analyze both publicly available and litigation produced data to identify trends, patterns, and outliers.

HEALTHCARE

In today’s digital age, large technology platforms generate enormous volumes of complex and often heterogeneous data. MK Analytics has extensive experience parsing and analyzing these large-scale datasets. Our work has included matters involving rideshare safety, social media use, AI training data, and more. We organize and validate high-volume records and assess what information could be derived from the platform’s data. Both co-founders have served as testifying expert witnesses in tech platform cases.

TECHNOLOGY PLATFORMS

MK Analytics combines publicly available geospatial data and satellite imagery with data and photos obtained through discovery to assess the impacts and severity of environmental events. Our comprehensive approach provides clients with accurate, data-driven assessments of past damages, enhancing their understanding of environmental consequences. As part of this work, we have developed interactive dashboards and maps for litigation, as well as expert reports.

ENVIRONMENTAL

As the cannabis industry matures, rigorous testing for potency and purity has become a norm, including assessing the levels of CBD and THC and checking for impurities such as pesticides, heavy metals, and microbiological contaminants. Recent concerns have arisen due to alleged inconsistencies in labeling, with some products purportedly containing lower than advertised THC levels or not meeting the required purity standards. MK Analytics’ rigorous analyses of seed-to-sale data identifies trends, patterns, and outliers in cannabis testing, aiding in creating a safer, more transparent landscape.

CANNABIS SAFETY TESTING

MK Analytics is at the forefront of using data science to combat illegal firearms trafficking, partnering closely with state and local governments. In collaboration with Everytown for Gun Safety, we’ve developed a proprietary software platform that helps authorities pinpoint potential straw purchasing activity. A significant feature of our platform is an index that assesses the likelihood of a firearm being trafficked into a specific jurisdiction, and a network analysis of purchasers and possessors to uncover insights that may not be readily apparent in traditional database models. Our in-depth analytics and user-friendly interface enable law enforcement agencies to leverage data for more proactive and effective interventions.

FIREARMS TRAFFICKING

Identifying discrimination and disparate impact relies heavily on data, such as analyzing for race/ethnicity-based or gender-based harms. Our work has helped both litigation and government clients distinguish bias from error or chance and ground claims of harm relating to protected characteristics in objective evidence. We have provided analyses as consultants and experts to determine whether discrimination was present in law enforcement activities and in judicial scheduling and outcomes and have also worked on matters involving sexual and gender-based violence, including cases that range from rideshare assault to technology-facilitated abuses (i.e., on social media platforms).
